Thank you for your interest in ericks.org. These Terms of Use (“Terms”) govern your access to and use of the ericks.org website, online library platform, and related services we make available (collectively, the “Site”).
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
Our Privacy Policy explains how we collect, use, and protect personal information when you use the Site.
1. Who we are and what we provide
ericks.org is an educational platform specializing in Neuro-Linguistic Programming (NLP) and hypnotherapy. Through the Site we offer:
- An online library of NLP books and audiobooks, accessible by streaming only (no downloads) under a membership subscription
- Links to Amazon and other retailers where our books are available for purchase
- Written and audio-visual educational materials
- A newsletter with NLP resources, updates, and professional development content
- General information and updates about NLP and hypnotherapy.
The Site is intended for informational and educational purposes. It is not a clinical practice, medical clinic, or emergency service.
2. No professional or clinical services
The Site and all content provided through it are for general education and personal or professional development only. They do not constitute:
- Medical advice, diagnosis, or treatment
- Psychological or psychiatric diagnosis or treatment
- Counseling, psychotherapy, or other licensed mental health services
- Any other regulated health or professional service
- Emergency or crisis services.
Nothing on the Site should be used to replace consultation with a qualified professional who can review your individual circumstances. You remain responsible for your own decisions and for seeking appropriate in-person guidance where needed.
If you are in crisis, at risk of harming yourself or others, or experiencing a medical emergency, you must contact local emergency services or crisis supports rather than using the Site.
3. Eligibility and account types
You must be at least 18 years old to use the Site.
If you use the Site on behalf of another person or an organization, you confirm that you have authority to accept these Terms on their behalf and that they will be bound by them.
We support the following types of users:
- Visitors: Individuals who browse publicly available pages, read content, and learn about NLP without creating an account.
- Registered members: Individuals who create an account to access free content or hold an active subscription to access the full online library of books and audiobooks.
You agree to:
- Provide accurate, current, and complete information when creating and maintaining an account
- Keep your login credentials confidential
- Take responsibility for all activity that occurs under your account.
We may suspend or close your account if we believe you have breached these Terms, posed a risk to the Site or other users, or provided false or misleading information.
4. Access to and use of the Site
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or professional use in line with these Terms.
You agree that you will not:
- Use the Site in any way that violates applicable law or regulation
- Use the Site to infringe intellectual property, privacy, or other rights
- Attempt to gain unauthorized access to any part of the Site, systems, or data
- Probe, scan, or test the vulnerability of the Site or its infrastructure
- Interfere with or disrupt the operation of the Site (including by introducing malware, flooding, or overloading the service)
- Use the Site to send unsolicited promotions, advertisements, or spam
- Reverse-engineer, decompile, or otherwise attempt to derive the source code or underlying structure of any part of the Site, except where permitted by law.
4.1 Security, scraping, and misuse
You must not, under any circumstances:
- Use bots, scripts, scrapers, crawlers, or other automated tools to access, copy, or monitor any part of the Site or library content
- Attempt to bypass, disable, or interfere with any security, encryption, or access-control mechanism
- Attempt to hack, disrupt, damage, or gain unauthorized access to the Site, our servers, or any associated systems
- Share, sell, or otherwise disclose your password or login credentials to any other person, or permit any other person to access the Site using your account.
We treat any attempt to scrape, hack, or gain unauthorized access to the Site, and any intentional password or account sharing, as serious breaches of these Terms. In these situations, we may:
- Immediately suspend or terminate your access to the Site and the online library, without notice
- Block devices, IP addresses, or accounts we reasonably associate with the conduct
- Take legal action, including seeking damages and injunctive relief, and cooperate with law-enforcement authorities where applicable.
Any attempt to circumvent security or misuse the Site may create civil or criminal liability in addition to contractual remedies.
We may change, suspend, or discontinue any aspect of the Site at any time without prior notice. We do not guarantee that the Site or any content will always be available or uninterrupted.
5. Content, intellectual property, and library access
5.1 Our content
All materials, text, graphics, logos, icons, images, audio, video, and other content on the Site (excluding your own submissions and clearly identified third-party materials) are owned by us or our licensors and are protected by copyright, trademark, and other laws.
“ericks.org” and related names, logos, product and service names, designs, and slogans are trademarks or service marks owned by us or our affiliates or licensors. You may not use these marks without our prior written consent.
5.2 Online library — streaming access only
When you hold an active membership subscription, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to stream and read books and audiobooks through the Site for the duration of your subscription period.
- All library content is accessible by online streaming only. No downloads of books, audiobooks, or any library files are permitted under any circumstances.
- Subscription access is for your personal use only. You may not share your login or permit any other person to access the library under your account.
- Enrollment does not transfer ownership of any content to you.
You agree that you will:
- Use library materials only for your own learning and professional development
- Not copy, record, screenshot, or otherwise reproduce any library content
- Not share, distribute, or transmit any library content to third parties.
Any broader use, including reproducing, adapting, translating, distributing, or creating derivative works from our materials, requires our prior written permission.
5.3 Amazon and third-party book links
The Site includes links to Amazon and other retailers where physical and digital editions of our books are available for purchase. These links are provided for your convenience. Any purchase you make through Amazon or another retailer is subject entirely to that retailer’s terms, pricing, and policies. We are not responsible for transactions conducted on third-party platforms.
5.4 Expiry of subscription access
At the end of your subscription period:
- Your right to access the online library automatically ends.
- We may deactivate your library access without further notice.
- You must not attempt to retain, duplicate, or access library content beyond the permitted streaming period.
We may, at our discretion, offer renewal discounts or promotions. Any renewal is subject to the then-current fees and terms.
5.5 Your contributions
You may submit questions, feedback, comments, reviews, or other content through the Site. By submitting any such material, you:
- Confirm that you have the right to share it
- Grant us a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, and distribute it in any media, for the purposes of operating, improving, and promoting the Site.
We are not obligated to use any submission. We may remove or edit submissions that we consider offensive, unlawful, misleading, or inconsistent with our values.
5.6 Third-party content and services
The Site may include links to third-party websites, platforms, or tools, and may incorporate payment processors, analytics services (including Google Analytics), or other third-party components. Any third-party content or services are subject to the terms and privacy policies of those providers.
We do not control or endorse third-party content and are not responsible for accuracy, completeness, legality, or security on external sites. Your interactions with third parties are solely between you and them.
6. Newsletter
If you subscribe to the ericks.org newsletter, you agree to receive periodic emails from us containing NLP educational content, updates, new library additions, and promotional information.
- You may unsubscribe at any time by clicking the unsubscribe link in any newsletter email or by contacting us directly.
- We will not send you marketing emails without your consent.
- Our newsletter practices comply with applicable anti-spam laws, including CAN-SPAM and GDPR where applicable.
- We will never sell or share your email address with third parties for their own marketing purposes.
7. Google and search engine policies
We use Google services, including Google Search Console and Google Analytics, to monitor and improve Site performance and visibility. By using the Site, you acknowledge that:
- Google may collect data about your use of the Site in accordance with Google’s Privacy Policy (available at google.com/policies/privacy).
- We comply with Google’s Webmaster Guidelines and do not engage in deceptive, manipulative, or spam-based SEO practices.
- Our Site content is indexed by Google and other search engines. If you submit content to the Site, it may appear in public search results.
You can opt out of Google Analytics data collection by using the Google Analytics Opt-out Browser Add-on, available at tools.google.com/dlpage/gaoptout.
8. Fees, subscriptions, and refunds
Access to the full online library requires an active membership subscription.
8.1 Fees and billing
When you purchase a subscription:
- You agree to pay the applicable fee shown at the time of purchase
- You authorize us and our payment processors to charge your chosen payment method for the full amount, including any applicable taxes
- You ensure that all billing information is accurate and that you are authorized to use the payment method provided.
We may correct pricing errors even after an order is submitted. All fees are payable in the currency stated at checkout.
8.2 Subscription refund policy
Because access to the full online library is granted immediately upon payment:
- Subscription fees are non-refundable once library access has been activated, except where required by applicable law.
- If you cancel your subscription, your access continues until the end of the current billing period and will not auto-renew.
- We do not provide partial refunds for unused subscription time.
We may, at our discretion, offer exceptions in cases of documented technical failures that prevented access. Any such exception must be confirmed by us in writing.
8.3 Disputes about charges
If you believe there is an error in a charge, you must contact us within 30 days of the charge appearing. We will review and respond within a reasonable time. Failure to raise concerns in that period may limit our ability to assist.
We may suspend access to the Site or library if payment is not received after reasonable notice.
9. Term, changes, and termination
These Terms apply from the first time you access the Site and continue until they are replaced or your access is ended.
We may update these Terms periodically. When we do, we will update the “Last updated” date and may provide additional notice where required. Your continued use of the Site after changes take effect means you accept the updated Terms.
You may stop using the Site at any time. You may request closure of your account by contacting us. Some obligations (for example, payment of fees already due, intellectual property provisions, and liability limitations) will continue after termination.
We may suspend or terminate your access at any time, with or without notice, if we believe you have breached these Terms, created risk, or engaged in misuse of the Site.
10. Indemnity
You agree to indemnify and hold harmless ericks.org, its owners, directors, employees, contractors, and affiliates from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Site or online library
- Your violation of these Terms or of any applicable law
- Your infringement of any intellectual property, privacy, or other rights of a third party
- Any content or information you submit or share through the Site.
11. Disclaimers
The Site and all content, library materials, and services provided through it are offered “as is” and “as available.”
We do not make any guarantees or warranties, express or implied, including:
- Warranties of accuracy, completeness, or reliability of content
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Site will be uninterrupted, secure, or error-free
- Warranties that reading or engaging with our materials will produce specific personal, professional, or clinical outcomes.
You are responsible for how you interpret and apply any information from the Site in your life or professional practice.
12. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Site.
- Our total liability for any claim arising out of or relating to these Terms or the Site will not exceed the greater of (a) the amount you paid to us for the subscription giving rise to the claim, or (b) one hundred US dollars (USD $100).
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
13. Dispute resolution
If you have a concern or dispute with us, you agree to contact us first and give us an opportunity to resolve it informally.
If a dispute cannot be resolved informally, it will be handled under the laws and dispute-resolution framework specified in the legal notices on the Site or in your country-specific agreement, if applicable.
Nothing in this section prevents either party from seeking urgent injunctive or equitable relief in a court of competent jurisdiction.
14. Copyright concerns
If you believe that material on the Site infringes your copyright, you may contact us with a written notice that includes:
- Identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material and where it appears on the Site
- Your contact details
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
- An electronic or physical signature.
We will review such notices and respond as appropriate, which may include removing or disabling access to the material.
15. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy and any other documents explicitly referenced, form the entire agreement between you and us regarding the Site.
- Severability: If a court finds any part of these Terms invalid or unenforceable, the remaining provisions remain in full force.
- No waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment: You may not assign your rights or obligations under these Terms without our consent. We may assign our rights and obligations in connection with a merger, acquisition, reorganization, or sale of assets.
- Territorial scope: The Site is accessible internationally. We make no representation that all content or services are appropriate or available in every location.
